British Columbia changed fundamentally in May 2021, and it changes what a lawyer is for. Under ICBC's Enhanced Care model, most people injured in a crash can no longer sue the other driver for pain and suffering. Instead you receive care and recovery benefits regardless of fault. Lawyers still matter here, just differently. The fight is now usually with ICBC over the benefits themselves: a denied treatment, a disputed permanent impairment rating, a cut-off of income replacement, or an appeal to the Civil Resolution Tribunal. Certain claims also remain outside the no-fault system entirely, including some against a driver convicted of a serious offence, and injuries that are not motor-vehicle related at all, such as slip and falls or medical malpractice.
